Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Creatoor AI service, website, and text-message features (collectively, the "Service") operated by Creatoor AI ("Creatoor AI," "we," "us," or "our"). By providing your phone number, checking the consent box, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service you represent and warrant that you meet these requirements.

2. The Service

Creatoor AI lets you create AI-generated talking-avatar videos ("AI Twin" videos) from a photo, a voice recording, and text prompts you submit, delivered to you over text message. We may add, modify, or discontinue features at any time.

3. Your Content; License to Your Voice and Likeness

"Your Content" means the photos, voice recordings, prompts, and other materials you submit. You retain ownership of Your Content. You grant Creatoor AI a limited, worldwide, non-exclusive, royalty-free license to host, process, reproduce, and create AI-generated derivative works from Your Content — including a synthetic version of your voice and likeness — solely for the purpose of operating and providing the Service to you.

You may revoke this license at any time by deleting your account or contacting us, after which we will cease generating new content from your voice and likeness and delete the underlying biometric inputs as described in our Privacy Policy. We do not sell your voice or likeness, and we do not use them to train models for other users or share them with third parties for their own purposes.

4. Your Representations

You represent and warrant that: (a) the voice and image you submit are your own, or you have obtained all necessary rights and consents; (b) Your Content does not infringe any third party's rights; and (c) you will not use the Service to impersonate any other person or to create misleading, defamatory, unlawful, or harmful content.

5. Acceptable Use

You agree not to use the Service to create content that is illegal, fraudulent, harassing, hateful, sexually explicit involving minors, or that impersonates another real person without authorization. We may suspend or terminate accounts that violate these Terms.

6. Free Videos, Trials, and Billing

The Service may offer a limited number of free videos and a paid subscription billed through our third-party payment processor. Prices, included usage, and billing terms are disclosed at sign-up. Subscriptions renew until cancelled. Except where required by law, payments are non-refundable.

7. Text Messages

By providing your number you consent to receive automated text messages from Creatoor AI. Message and data rates may apply. Reply STOP to opt out or HELP for help. Consent to texts is not a condition of any purchase beyond the Service itself.

8. Intellectual Property

The Service, excluding Your Content, is owned by Creatoor AI and protected by intellectual-property laws. Subject to these Terms, you may use the videos we generate for you, including for commercial purposes, provided your use complies with these Terms and applicable law.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated output will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, Creatoor AI will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Creatoor AI from any claims, damages, or expenses arising from Your Content, your use of the Service, or your breach of these Terms.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use of the Service after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the jurisdiction in which Creatoor AI is established, without regard to conflict-of-law principles.
